Abstract(s)
A presente dissertação aborda a problemática das fake news e da desinformação, enquanto tema emergente na sociedade moderna, com implicações diretas para a liberdade de expressão, centrando-se, designadamente, nas disposições e regulamentações jurídicas já existentes a nível europeu e nacional. É cada vez mais frequente ouvir-se falar da desinformação enquanto ameaça à saúde e democracia pública, impondo-se uma atuação urgente para combater este problema, questionando-se, assim, se a criminalização poderá ser uma via a seguir. Para tal, é fundamental definir o conceito, distinguindo as diferentes formas de desinformação e as especificidades associadas ao mesmo, como surge e se propaga nos dias de hoje, conexionando-o com a liberdade de expressão e de imprensa, ponderando as consequências que novas formas de atuação legislativa podem trazer para estes direitos numa tentativa de combater este fenómeno preocupante e crescente.
This dissertation addresses the issue of fake news and disinformation as an emerging theme in modern society, with direct implications for freedom of expression, focusing, in particular, on existing legal provisions and regulations at European and national level. It is increasingly common to hear about disinformation as a threat to health and public democracy, imposing urgent action to combat this problem, thus questioning whether criminalization can be a way forward. To this end, it is essential to define the concept, distinguishing the different forms of disinformation and the specificities associated with it, as it appears and propagates today, connecting it with freedom of expression and the press, considering the consequences that new forms of legislative action can bring to these rights to combat this worrying and growing phenomenon.
