Ainda que legalmente atípica, a garantia autónoma é uma garantia pessoal das obrigações
totalmente enraizada na sociedade, sendo resultado das necessidades da prática comercial.
Na presente dissertação, discutir-se-ão alguns aspetos respeitantes à garantia autónoma,
como o seu conceito de autonomia, que entidades têm legitimidade para a prestar e, em
especial, a transmissibilidade da mesma, tanto em caso em caso de cessão automática com
o crédito garantido, como no que respeita à (im)possibilidade da sua transmissão isolada.
Although legally atypical, the autonomous guarantee is a personal guarantee of obligations that is fully rooted in society and is a result of the needs of commercial practice. In this dissertation, some aspects concerning the autonomous guarantee will be discussed, such as its concept of autonomy, which entities have legitimacy to provide it and, in particular, its transmissibility, both in the case of its automatic assignment along with the guaranteed credit and with regard to the (im)possibility of its isolated assignment.
