Neste trabalho, sobre a desarticulação do Código das Expropriações com a Lei de
Bases Gerais da Política Pública de Solos, de Ordenamento de Território e do Urbanismo
e o Regime Jurídico dos Instrumentos de Gestão Territorial, analisamos os diferentes
regimes jurídicos e comparamos a classes do solo, a sua qualificação e a avaliação do solo
para efeitos indemnizatórios provenientes da expropriação, quer seja de sacrifício, quer
seja a clássica.
Pretendemos com o mesmo que futuramente haja uma revisão ao Código das
Expropriações, para que seja possível articular-se os diferentes diplomas, de modo a que
a classificação e a determinação do montante da indemnização, quer seja efetuada por
um, ou outro diploma, sejam concordantes.
In this work, upon the disarticulation of the Expropriations’ Code with the Law of General Basics of Land Use Planning and Urbanism, and the Legal Regime of Territorial Management Instruments, we analyse the different legal regimes and compare classes of land, its qualification and the evaluation of the land for compensatory effects resulting from the expropriation, whether of sacrífice or the classic one. We also intend to revise the Exprpriations’ Code in the future, in order to enable the articulation of different diplomas, which allow the classification and determination of the amount of compensation, whether carried out by one or another diplomas, to be concordant.
