Abstract(s)
A presente dissertação tem como objetivo promover a reflexão sobre o tratamento da negligência no sistema penal português, nomeadamente no que diz respeito às pessoas mais velhas. Num primeiro momento, abordaremos os conceitos de negligência e de família de acolhimento, definindo as suas obrigações, incluindo o dever especial de cuidado. Em seguida, procederemos à análise da proteção legal conferida às pessoas mais velhas em Portugal e no direito comparado. Posteriormente, dedicaremos especial atenção à proteção jurídico-penal das pessoas mais velhas inseridas em famílias de acolhimento, em situações de negligência, por ser a este nível que se colocam os principais problemas. Analisaremos alguma jurisprudência relevante sobre esta matéria e, por fim, apresentaremos uma proposta de reforma legislativa, visando o reforço da proteção jurídico-penal dos idosos.
The following dissertation aims to promote reflection on the treatment of negligence in the Portuguese Criminal Justice System, particularly concerning older people. First, we will address the concepts of neglect and foster family, defining their obligations, including the special duty of care. Next, we will proceed to the analysis of the legal protection granted to older people in Portugal, complemented by a comparative law perspective. Then, we will devote special attention to the criminal law protection of older people in foster families, in situations of neglect, as it is at this level that the main problems arise. We will analyze some relevant case law on the subject and, finally, we will propose legislative reforms, aiming to strengthen the criminal law protection of the elderly.
