As sociedades desportivas têm vindo a assumir destaque, especialmente naquele que é o desporto mais seguido em Portugal: o futebol.
Dentro do regime que se lhes aplica são vários os lapsos apontados, dos quais destacamos no presente trabalho os relacionados com a proteção do clube fundador na SAD, por se nos afigurar como um problema que urge resolver a bem do futuro do desporto português e dos clubes desportivos, da sua natureza e escopo.
Assim, o objetivo deste trabalho é o de procurar soluções para problemas relacionados com a temática da posição do clube desportivo na SAD que funda, analisando, nomeadamente, ordenamentos estrangeiros e as suas previsões quanto a esta questão.
Apesar de reconhecermos fragilidades às soluções apresentadas e defendidas, é nossa opinião que as mesmas são viáveis, necessárias e proporcionais para problemas atuais e futuros, e por tal entendemos ter logrado o objetivo ao qual nos propusemos, com a realização desta dissertação.
Sports societies have been achieving great relevance, especially on what the most followed sport in Portugal is concerned: football. Within the legal dispositions that apply, several lapses are to be pointed out, among which we highlight, in this essay, those related to the protection of the founding club in the SAD, mainly because it seems to be a problem that needs to be solved for the sake of the prosperity of the future of Portuguese sport and sport clubs, its nature and scope. Therefore, the objective of this work is to seek solutions for problems related to: the issue of the founder sport club position in the SAD, analyzing, in particular, foreign dispositions and their predictions on this issue. Although we recognize weaknesses in the presented and defended solutions, it is our opinion that they are feasible, necessary and proportional to current and future problems, and we therefore consider having achieved the goal we set for this dissertation.
