| dc.description.abstract | Nesta dissertação propomo-nos a estudar a temática do Match Fixing, abordando esta de um ponto de vista dogmático e demonstrando as interligações entre o Direito do Desporto e o Direito Penal, duas realidades aparentemente afastadas, mas com uma relação cada vez mais simbiótica. Ao mesmo tempo, abordaremos as várias definições doutrinárias de ética e fair play, enquadrando o Match Fixing como uma realidade atentatória a estas, demonstrando a imperiosidade da sua proteção para assegurar o importante papel sociocultural do Desporto. Estudaremos ainda o tema do Doping, que por limitação de caracteres não será tão aprofundado, centrando- se o nosso estudo numa análise do bem jurídico afetando, revelando desde já que se trata de outra realidade atentatória à ética desportiva. Centraremos assim o nosso foco no Match Fixing, com análise da legislação nacional, nomeadamente da Lei 50/2007 de modo a aprofundar os crimes em que este se pode consubstanciar. Não deixaremos, porém, de aprofundar a legislação europeia como vetor essencial do combate ao Match Fixing, com especial enfoque na Convenção de Magglingen/Macolin. Auxiliaremos a análise do Match Fixing com o recurso a casos recentes, de modo a permitir a compreensão sobre esta temática cada vez mais presente na realidade desportiva. Por fim, recorreremos ao Direito Comparado para compreendermos o enquadramento legislativo europeu em que Portugal se encontra e que será fundamental para concluirmos sobre o estado da legislação portuguesa. | pt_PT |
| dc.description.abstract | In this dissertation we propose to study the theme of Match Fixing, approaching it from a dogmatic point of view and demonstrating the interconnections between Sports Law and Criminal Law, two distant realities, but with an increasingly symbiotic relationship. At the same time, we will address the various doctrinal definitions of ethics and fair play, framing Match Fixing as a reality that violates this, demonstrating the imperative of its protection to ensure the important sociocultural role of Sport. We will also study the topic of Doping, which due to character limitations will not be as in-depth, focusing our study on an analysis of the legal interest affecting it, revealing from the outset that it is another reality that threatens sporting ethics. We will therefore put our focus on Match Fixing, with an analysis of national legislation, namely Law 50/2007 to delve deeper into the crimes in which this can be substantiated. However, we will not fail to deepen European legislation as an essential vector in the fight against Match Fixing, with a special focus on the Magglingen/Macolin Convention. We will assist in the analysis of Match Fixing using recent cases, to allow understanding of this issue that is increasingly present in the sporting reality. Finally, we will turn to Comparative Law to understand the European legislative framework in which Portugal finds itself and which will be fundamental to conclude the state of Portuguese legislation. | pt_PT |
