A ação especial de tutela da personalidade sofreu mudanças significativas com a entrada em vigor do CPC de 2013. A presente dissertação procura refletir sobre a utilidade e adequação do regime atualmente previsto face aos objetivos da alteração legislativa. Para o efeito, começa por analisar o motivo subjacente à consagração do processo especial e refletir sobre a pertinência das alterações, atendendo à evolução do recurso à ação especial nos últimos 10 anos. Através da comparação com o procedimento cautelar e com a forma de processo comum, debatem-se questões relacionadas com a coordenação entre os vários meios de tutela dos direitos de personalidade, as garantias de defesa do réu ao abrigo do processo especial e a admissibilidade de cumulação de pedido indemnizatório.
The special procedure for the protection of personality rights underwent significant changes with the advent of the 2013 Portuguese Code of Civil Procedure. This dissertation seeks to reflect on the usefulness and suitability of the current system in light of the objectives of the legislative change. To this end, it begins by analysing the reason behind the establishment of the special procedure and reflects on the relevance of the changes, attending to its usage over the last 10 years. Through a comparison with the provisional measures and the ordinary form of procedure, issues related to the coordination between the various means of protecting personality rights in court, the defendant's defence guarantees under the special procedure and the admissibility of cumulative compensation claims are discussed.
