| dc.description.abstract | As leis de patentes concedem patentes tendo em vista a proteção de determinadas invenções, mas excluindo outras, podendo, por diversas vezes, estar no limiar entre fornecer incentivos suficientes para estimular a inovação e evitar os perigos da superproteção. Atualmente, as Câmaras de Recurso, no IEP, têm sido encarregues de interpretar a Convenção sobre a Patente Europeia de acordo com os desenvolvimentos tecnológicos. Como será discutido neste trabalho, esta tarefa tem frequentemente causado disparidades. A recente culminação deste fenómeno é a referência muito importante à decisão G 1/19, relativa à patenteabilidade de simulações implementadas por computador. Esta decisão tem potencial para iluminar a patenteabilidade de invenções implementadas por computador na Europa. | pt_PT |
| dc.description.abstract | Patent laws grant patents with a view to protecting certain inventions, but exclude others, and can often be on the threshold between providing sufficient incentives to stimulate innovation and avoiding the dangers of over-protection. Currently, Boards of Appeal, at the EPO, have been tasked with interpreting the European Patent Convention in line with technological developments. As will be discussed in this paper, this task has often caused disparities. The recent culmination of this phenomenon is the very important reference to G 1/19, concerning the patentability of computer implemented simulations. This case has the potential to shed light on the patentability of computer-implemented inventions in Europe. | pt_PT |
