O trabalho forçado ou obrigatório faz parte de um direito negativo presente no artigo 4.º/2 da Convenção Europeia dos Direitos do Homem. No entanto, esta não apresenta qualquer definição do conceito e, com vista à compreensão do mesmo, elaborámos a presente dissertação, por considerarmos tratar-se de um tema atual e pertinente. Analisámos o conceito apresentado pela Convenção n.º 29 da Organização Internacional do Trabalho sobre Trabalho Forçado ou Obrigatório de forma a determinar se o mesmo é aplicável, e suficiente, à garantia da aplicação da Convenção Europeia dos Direitos do Homem efetuada pelo Tribunal Europeu dos Direitos do Homem.
Forced or compulsory labour is part of a negative right exacted in article 4.º/2 of the European Convention on Human Rights. However, this treaty provides no definition of the concept and, in order to understand it, we developed this dissertation because we believe in the relevance and the actuality of the theme. We analyzed the concept presented by International Organization Labour Convention n.º 29 on Forced or Compulsory Labour in order to determine the sufficiency of its applicability in the task carried out by the European Court of Human Rights – ensuring the European Convention on Human Rights.
