Abstract(s)
A presente dissertação incide sobre a publicidade das decisões arbitrais proferidas no âmbito da arbitragem de Direito Administrativo, atualmente imposta e regulada pelo artigo 185.º- B do Código de Processo nos Tribunais Administrativos. Cientes da importância que a publicidade das referidas decisões reveste – a qual nos propomos demonstrar – pretendemos, em jeito de alerta, identificar as várias limitações que a referida solução legislativa apresenta. Por se encontrar comprometida a publicação das decisões arbitrais em matéria administrativa, ousaremos delinear uma proposta de alteração do regime vigente, de modo a assegurar uma efetiva publicidade dessas decisões.
The present dissertation focuses on the publicity of arbitration decisions rendered within the scope of Administrative Law arbitration, currently imposed and regulated by article 185.º-B of the Code of Procedure in Administrative Courts. Aware of the importance that the publicity of the aforementioned decisions entails – which we propose to demonstrate – our aim is metaphorically “sound the alarm”, by identifying the various limitations that the aforesaid legislative solution presents. Given that publication of arbitration decisions concerning administrative matters is at risk, we will endeavour to outline a proposal for change the current regime, in order to ensure that the publicity of these decisions is enforced.
