O presente estudo analisa o fenómeno da alienação parental a partir de uma abordagem interdisciplinar e a correlação entre os ordenamentos jurídicos do Brasil e de Portugal. Partindo da compreensão da alienação parental como uma forma de violência psicológica que afeta profundamente o desenvolvimento emocional da criança, a investigação debruça-se sobre os reflexos deste fenómeno no contexto familiar contemporâneo, especialmente em situações de separação ou divórcio com elevado grau de conflito. Através da análise teórica e legislativa, são identificadas as manifestações típicas da alienação parental, os seus impactos na estrutura familiar e os desafios enfrentados pelos sistemas jurídicos na sua identificação e tratamento. A pesquisa destaca ainda os debates científicos e jurídicos em torno da Lei n.º 12.318/2010, brasileira, e os caminhos seguidos por Portugal no reconhecimento da residência alternada. No plano das soluções, são exploradas duas ferramentas fundamentais: a mediação familiar, amplamente promovida no Brasil como alternativa ao litígio, e a residência alternada, que ganha expressão no ordenamento jurídico português. Conclui-se que ambas podem funcionar de forma complementar na prevenção e mitigação da alienação parental, desde que aplicadas com o devido acompanhamento técnico. Os resultados apontam para a necessidade de uma justiça de família mais humanizada e interdisciplinar, que combine estratégias restaurativas, promovendo a manutenção de vínculos afetivos saudáveis entre os filhos e ambos os progenitores. This study analyzes the phenomenon of parental alienation from an interdisciplinary perspective, examining the correlation between the legal systems of Brazil and Portugal. Starting from the understanding of parental alienation as a form of psychological violence that profoundly affects the child's emotional development, the research investigates the repercussions of this phenomenon in the contemporary family context, particularly in situations of separation or divorce involving a high degree of conflict. Through theoretical and legislative analysis, the typical manifestations of parental alienation, its impacts on the family structure, and the challenges faced by the legal systems in its identification and treatment are identified. The research also highlights the scientific and legal debates surrounding Brazilian Law No. 12,318/2010 and the approaches followed by Portugal regarding the recognition of alternating residence. In terms of solutions, two fundamental tools are explored: family mediation, widely promoted in Brazil as an alternative to litigation, and alternating residence, which is gaining recognition in the Portuguese legal system. It is concluded that both can work in a complementary way to prevent and mitigate parental alienation, provided they are applied with appropriate technical support. The results point to the need for a more humanized and interdisciplinary family justice system, one that combines restorative strategies to promote the maintenance of healthy affective bonds between children and both parents. Finally, the study recommends enhancing the specialized training of the professionals involved.
