A igualdade de género na constância do casamento e aquando do divórcio

Abstract(s)
No estudo em questão focamo-nos na análise dos institutos jurídicos do casamento e do divórcio sob a ótica da igualdade de género. Tivemos como objetivo perceber se estes institutos conferem uma igualdade tanto formal como prática. Com tal desiderato, começamos por abordar o sexo/género enquanto fator de discriminação. Seguidamente, sob forma de contextualização, fomos retraçando o caminho percorrido até ao momento em que alcançamos uma igualdade de género a nível legislativo. Contudo, tais disposições igualitárias não sortiram efeito na prática, pois não tiveram em conta a realidade social em que vivemos. Afigura-se-nos essencial pensar o Direito de forma a que ele seja um agente ativo na promoção da igualdade real, foi exatamente isso que nos desafiamos a fazer. Primeiramente, analisamos de que forma os princípios da igualdade dos cônjuges e da direção conjunta da família influenciam os efeitos pessoais do casamento. De seguida, debruçamo-nos sobre os deveres conjugais e de que forma a violação destes pode contribuir para a dissolução do casamento. De forma a combatermos a “feminização da pobreza” propusemos alterações aos institutos jurídicos dos alimentos e do crédito compensatório, e uma contemplação por parte da legislação que ofereça uma maior valorização do trabalho doméstico e do cuidado de dependentes. Posteriormente, explicitamos a razão por que achamos que a violação de deveres conjugais pode implicar uma situação de responsabilidade civil extracontratual. Finalmente, analisamos de que forma as decisões por parte dos Tribunais são influenciadas por preconceções sociais e a necessidade de quem aplica a lei ser sensível a estas questões de género. Concluímos, apelando a toda a comunidade jurídica para que aposte na formação no domínio da igualdade de género e direitos das mulheres.
In the study in question, we focused on the analysis of the legal institutions of marriage and divorce from the perspective of gender equality. Our objective was to understand whether these institutions provide both formal and substantive equality. Firstly, we started by addressing sex/gender as a factor of discrimination. We then proceed to retrace the legislative path until the moment the law made equal provisions for both genders. However, these egalitarian provisions did not have an effect in practice, as they failed to take into account the social reality in which we live in. It is paramount that we think of the law as an active agent capable of promoting substantive equality between genders, so that is why we tried to think of ways or changes we could make to the law to better tackle the issue in question. Initially, we analysed how the principle of equality of the spouses and the principle of shared decision-making influenced the personal effects of marriage. We then went on to examining how the violation of spousal duties could contribute to the dissolution of the marriage. In an effort to address the problem of the “feminization of poverty” we proposed changes to the legal mechanisms of alimony and compensatory credit, alongside a legislative provision that guarantees a greater recognition of domestic work and care for the dependents. Lastly, we analysed how court decisions are influenced by social preconceptions and the need for those who apply the law to be in tune with these gender issues. We concluded by addressing the entire legal community on the need of investing in training in the field of gender equality and women’s rights.
