A presente dissertação foca-se na arbitrariedade da detenção indefinida de milhares de crianças estrangeiras, alegadamente conexas ao Daesh, no campo Al-Hol no Nordeste da Síria, em virtude da violação de normas de Direito Internacional Humanitário, Direito Internacional dos Direitos Humanos e Direito Internacional Criminal, aplicáveis a conferir-lhes a devida proteção. Ao mesmo tempo, tendo presente o tratamento humilhante e degradante a que estão sujeitas, bem como a recusa dos seus Estados de Origem em providenciar a sua libertação e repatriamento, procura identificar estas crianças como atendíveis ao estatuto de refugiadas, demonstrando que preenchem todos os requisitos necessário a adquirir essa condição.
This dissertation focuses on the arbitrary detention of thousands of foreign children allegedly associated with Daesh at al-Hol camp in Northern Syria, as it violates relevant international humanitarian law, international human rights law, and international criminal law protecting children. At the same time, taking into consideration the tortuous treatment they receive during their detention, and the fact that most States refuse to contribute to their release and repatriation, it argues that the foreign children at al-Hol camp meet the requirements for refugee status.
