Abstract(s)
O surgimento das trotinetas elétricas em regime partilhado revolucionou o conceito de
mobilidade urbana. Enquanto meios de transporte com atributos particulares, que rapidamente se
tornaram num produto de massas com a utilização intensiva por parte do segmento dos jovens
adultos, a circulação destes veículos trouxe várias polémicas, desde logo no que respeita à
segurança rodoviária e ao seu estacionamento, tendo-se registado a ocorrência de uma série de
acidentes. Na presente dissertação começa-se por dar a conhecer as suas características, o modelo de
negócio em que se inserem, e a forma como as empresas de sharing se encontram a operar em
Portugal, em especial na cidade de Lisboa. Neste contexto, partindo da legislação e regulamentação
existente, procurou-se oferecer linhas orientadores de resposta à seguinte questão: ocorrendo um
acidente, quem poderá o terceiro lesado responsabilizar? E a que título?
The emergence of shared electric scooters revolutionized the concept of urban mobility. As a means of transport with particular attributes, which quickly became a mass product with its intensive use by the young adult segment, the circulation of these vehicles has brought about several controversies, concerning road safety and parking, with the occurrence of several accidents. In our study, we address their characteristics, the business model in which they operate, and the way sharing companies are operating in Portugal, especially in the city of Lisbon. In this context, based on the existing legislation and regulations, we sought to offer guidelines to answer the following question: in the event of an accident, who may the injured third party hold liable? And on what basis?
