Resumo: O presente estudo analisa dados de entrevistas a profissionais que trabalham na área da justiça, com o objetivo de examinar as suas perceções relativamente à aplicação da medida de prisão preventiva a jovens ofensores menores de dezoito anos. Dezassete profissionais foram entrevistados e, a partir da análise de dados, emergiram cinco temas: 1) fatores negativos associados à prisão preventiva; 2) fatores positivos associados à prisão preventiva; 3) medidas de coação alternativas à prisão preventiva; 4) necessidade de existirem alterações da atuação do sistema jurídico perante jovens ofensores; 5) impacto da prisão preventiva na trajetória de vida de jovens ofensores. Os resultados sugerem que a detenção preventiva pode constituir-se como positiva quando a segurança da sociedade é considerada, porém, pode constituir-se como negativa quando somente o jovem ofensor é considerado. Além do mais, a detenção preventiva parece acarretar consequências a longo prazo para o jovem ofensor e para a sociedade, quando este reintegra a sociedade.
Abstract: The present study analyzes data from interviews with professionals, that work in the justice service, with the aim to examine their perceptions regarding the application of pre-trial detention to young offenders. Seventeen professionals were interviewed and from the data analysis five themes emerged: 1) negative factors associated with pre-trial detention; 2) positive factors associated with pre-trial detention; 3) alternatives to pretrial detention; 4) needs for changes in the legal system’s stance towards young offenders; 5) impact of the pre-trial detention in the life course of young offenders. The results suggest that pre-trial detention can constitute itself as positive when the security of the society is considered, however, it constitutes itself as negative when only the young offender is considered. This way, the benefits that are gained for the society, when the young offender is detained, aren’t an effective option when balancing with the cost or outcome of when the young offender reenters society.
