Abstract(s)
A presente dissertação versará sobre uma análise abrangente e multidisciplinar dos crimes de ódio, na expectativa de conhecer a fundo os bastidores destes crimes. Face à preponderância e ao aumento dos crimes de ódio no Mundo, revela-se fundamental abordar esta temática, por forma a melhor compreendermos os impactos gerados e a forma como os diversos ordenamentos jurídicos se posicionam sobre a presente matéria. Deste modo, faremos uma análise exaustiva do impacto dos crimes de ódio no ordenamento jurídico português, assim como, no direito internacional, com o intuito de investigar minuciosamente os aspetos legais e sociais subjacentes a esta matéria. Não obstante, focar-nos-emos na temática da possível autonomização dos crimes de ódio, assim como, na eventual influência das sociedades na origem e prática destes crimes. Face à repercussão dos crimes de ódio nas suas vítimas, às lacunas e problemas estruturais apresentados no ‚âmbito do ordenamento jurídico português, finalizaremos o presente estudo, direcionando a nossa atenção para a exposição das formas de atuação que se revelam mais apropriadas e eficazes no combate destes crimes.
The present dissertation will focus on a comprehensive and multidisciplinary analysis of hate crimes, aiming to deeply understand the intricacies of these offenses. Given the prevalence and increasing occurrence of hate crimes worldwide, it is crucial to address this issue in order to better understand the generated impacts and how different legal systems position themselves on this matter. Thus, we will conduct an exhaustive analysis of the impact of hate crimes on the Portuguese legal system, as well as on international law, intending to thoroughly investigate the legal and social aspects underlying this subject. Moreover, we will focus on the theme of the possible delineation of hate crimes, as well as on the potential influence of societies on the origin and practice of these offenses. Considering the impact of hate crimes on their victims, along with the gaps and structural problems within the Portuguese legal system, we will conclude this study by directing our attention to the presentation of the most appropriate and effective forms of action in combating these crimes.
