O crescente desenvolvimento do setor tecnológico tem provocado um importante crescimento nos mercados de Big Data. Estes, por sua vez, enquanto tecnologia disruptiva, originam sérios desafios jurídicos, em especial relativos ao Direito de Propriedade Intelectual. Com o presente estudo, procuramos apurar até que ponto é que as bases de dados decorrentes de Big Data se encontram (des)protegidas pela legislação vigente. Em particular iremos avaliar a aplicabilidade da Diretiva relativa à proteção das bases de dados, em contexto de Big Data.
The growing development of the technology sector has caused a significant growth in the Big Data markets. As, a disruptive technology, Big Data poses serious legal challenges, especially regarding Intellectual Property Law. With this study, we seek to understand to what extent the databases arising from Big Data are (un)protected by current legislation. In particular, we will assess the applicability of the Directive on the protection of databases in the context of Big Data.
