Abstract(s)
A inovação tecnológica contribuiu para o aparecimento de um novo modelo de organização empresarial: economia colaborativa (ou UBER economy). O crescente espaço e mercado que as empresas que operam neste modelo têm vindo a conquistar, pela sua cada vez maior relevância e dimensão, levantam inúmeras questões jurídicas interessantes, designadamente as relativas ao direito da concorrência e ao direito do trabalho. Neste estudo pretendemos indagar a integração desta nova realidade nos ditames do direito constituído, colocando em crise a adequação do atual Direito do Trabalho à regulação das relações estabelecidas entre as empresas (ditas tecnológicas) e os seus trabalhadores/prestadores de serviços. Questiona-se a qualificação dos trabalhadores enquanto subordinados, avaliando a aplicação do método indiciário, e dos respetivos e tradicionais indícios, a este novo tipo de trabalhadores. Com o fito de alcançar a solução que melhor acautele a proteção destes e as expectativas de crescimento daquelas empresas, equacionam-se as possibilidades de autorregulação, negociação coletiva e intervenção legislativa.
Technological innovation has contributed to the rise of a new business organization model: collaborative economy (or UBER economy). The increasing number of companies operating in this model highlighted them on the market. Its boosting relevance and dimension raises several very interesting legal issues, in particular those related to competition and labor law. In this study we intend to deal with the integration of this new reality in law dictates by putting in crisis the adequacy of current labor law to the regulation of relations between companies (so-called technological) and its employee / service providers. We will question their qualification as employee and evaluate the evidential method and its traditional indicators’ application to this new type of workers. With the aim of achieving the solution that will safeguard the protection of these and the growth expectations of those companies, we will approach the possibilities for self- regulation, collective bargaining and legislative intervention.
