Abstract(s)
O assédio moral no local de trabalho é uma realidade preocupante de que muitos trabalhadores são vítimas, causando-lhes vários problemas quer a nível físico quer a nível psicológico.
Para além de todo o sofrimento a que uma vítima de assédio moral é submetida, vê-se ainda confrontada com outro problema: a dificuldade da prova.
É precisamente sobre a dificuldade de prova nos casos de assédio moral no local de trabalho que esta dissertação se debruça.
O objetivo deste trabalho é tentar perceber se o que existe neste momento na legislação laboral portuguesa é suficiente para que as vítimas consigam provar as situações de assédio moral alegadas ou se, pelo contrário, o que existe é insuficiente e é necessário ir mais longe, nomeadamente alterando o regime de prova.
Finalmente, apresentaremos os motivos que nos levam a defender uma alteração ao regime de prova nos casos de assédio moral no local de trabalho, apreciando em particular o mecanismo da inversão do ónus da prova com importante medida de prevenção e combate a este fenómeno.
Mobbing is a worrisome reality that many workers are victims of, causing them several physical and psychological problems. In addition to all the suffering that a victim of mobbing is subjected to, they are still confronted with another problem: the difficulty of proof. It is precisely about difficulty of proof in cases of mobbing in the workplace that this dissertation will debate about. The purpose of this work is to try to understand if what is currently in Portuguese labor law is sufficient for the victims to prove the alleged mobbing or if, what currently exists is insufficient and it is necessary to go further, in particular by changing the system of proof. Finally, we will present the reasons that lead us to defend an alteration to the system of proof in cases of mobbing in the workplace, particularly appreciating the mechanism of reversing the burden of proof with an important measure of prevention and combat this phenomenon.
