Abstract(s)
Com este estudo, pretendemos abordar a consagração legal do direito de oposição do trabalhador que, no contexto da transmissão de unidade económica, vise obstar à subrogação ope legis da titularidade da posição de empregador no seu contrato de trabalho. Analisando o regime, salientamos a importância dos fundamentos considerados pelo legislador como bastantes para tal e alertamos em simultâneo para a sua dificuldade de aplicação prática, sobretudo pela exigência probatória imposta ao trabalhador. Levantamos ainda questões relacionadas com a instrumentalidade do dever de informação, do transmitente e do transmissário, cujo não cumprimento ou cumprimento defeituoso poderá inviabilizar o exercício do direito de oposição. Suscitamos, por último, a questão do destino a dar ao contrato de trabalho quando o exercício deste direito, tendo por consequência a manutenção do vínculo com o transmitente, se depare com situações em que o primitivo empregador não dispõe de postos de trabalho aos quais possa reconduzir o trabalhador opositor.
This paper aims to analyse the legal enshrinement of the worker’s right of opposition, in the context of the transfer of the economic unit, as a form to inhibit the ope legis subrogation of the position of employer in his employment contract. By examining the regime, we seek to stress the importance of the requirements set by the legislator, as well as to heighten the difficulties in their pratical application given the legal burden that falls upon the worker. We also aim to question, namely, the instrumentality of the transferor and transferee’s duty to provide information, whose nonfulfillment or defective fulfilment might frustrate the exercise of the stated right. Lastly, we raise the issue of the “fate” of employment contracts upon the performance of this right, i.e. the maintenance of the employment relationship, particularly when the original employer can no longer guarantee a job position to the opposing worker.
