Abstract(s)
A dissertação que se segue terá como objeto de estudo o problema da (in)compatibilização da imagem digital criada pela entidade empregadora e a imagem digital criada pelos trabalhadores que prestam o seu trabalho por conta desta. Como não podia deixar de ser, analisamos a importância desta imagem digital para as partes envolvidas, na entrada da segunda década do segundo milénio. Atenta a dificuldade, inerente ao contrato de trabalho, de fazer uma distinção clara entre o sujeito prestador da atividade laboral e a força de trabalho por este disponibilizada, heterodeterminada pelo empregador, analisaremos os direitos de personalidade em conflito e os limites a estes reconhecidos pela doutrina e pela jurisprudência, para encontrar um modo de compatibilizar e equilibrar a proteção do trabalhador, enquanto parte mais suscetível de sair lesada na execução do contrato de trabalho, e, por outro lado, os interesses económicos da entidade empregadora, garantindo e zelando pelo direito ao bom-nome, à honra, à sua reputação e, em consequência, garantindo o normal funcionamento da empresa, a si associada.
The following dissertation is going to focus and study the problem of (in)compatibility of the digital image created by the employer and the digital image created by the employees, who provide their work on account of this. As it should be, we analyze the importance of this image for the parties involved, at the entrance of the second decade of the second millennium. In view of the difficulty inherent in the employment contract, to make a clear distinction between the subject providing the labor activity and the work force made available by the employees, we will analyze the personality rights of both parties and the limits recognized by the doctrine and by court’s decisions, in order to find a way to harmonize and balance the protection of the employee, as the most susceptible part of being injured in the execution of the employment contract, and, on the other hand, the economic interests of the employer, guaranteeing and ensuring his right to a good name, honor, reputation and, consequently, guaranteeing the normal functioning of the company.
