| dc.description.abstract | 25 de maio de 2016 entrou em vigor o Regulamento Geral sobre a Proteção de Dados (doravante Regulamento) na União Europeia, Regulamento este que codifica um direito que tem sido objeto, por largos anos, de uma calorosa e controversa discussão na doutrina, jurisprudência e nos media - o Direito ao Esquecimento. A presente dissertação pretende acompanhar a evolução deste direito desde os seus primórdios, que se encontram no ordenamento jurídico francês, passando pela Diretiva n.º 95/46/CE do Parlamento Europeu e do Conselho, bem como pelo Caso Google Spain, ao qual será dado especial enfoque, até ao novo Regulamento, de forma a determinar se este se trata de um Direito criado ex novum, ou se, pelo contrário, já se encontrava previsto em anterior legislação da União Europeia. Ainda será realizada uma breve análise crítica deste direito havendo, no nosso entender, aspetos que dificultam a implementação deste Direito que merecem ser devidamente referidas. | pt_PT |
| dc.description.abstract | On May 25, 2016, the General Regulation on Data Protection (hereafter Regulation) entered into force in the European Union, a regulation that codifies a right that has long been the object of a heated and controversial discussion in doctrine, jurisprudence and the media - the Right to be Forgotten. This dissertation aims to follow the evolution of this right from its beginnings in the French legal order, through Directive 95/46 /EC of the European Parliament and of the Council and by the Google Spain case, to which special focus will be given , to the new regulation, in order to determine whether it is a Right created ex novum, or whether, on the contrary, this Right was already provided for in European Union law. A brief critical analysis of this right will still be carried out existing, in our view point, aspects that make it difficult to verify the implementation of this Law that deserve to be mentioned. | pt_PT |
