Abstract(s)
A presente dissertação irá versar sobre a problemática aplicação de uma mesma moldura legal aos comportamentos de incitamento e auxílio ao suicídio, cuja prática se traduz na verificação do tipo de ilícito do art. 135º do CP, o que tem suscitado alguma controvérsia tanto na doutrina como na jurisprudência, gerando, ainda, inquietação em áreas ligadas à ética, à moral e à religião. Inicialmente, será feita uma exposição acerca da inviolabilidade do direito à vida (art. 24º da CRP), aludindo à sua força constitucional assim como, à controversa existente entre este direito e a autonomia do ser humano, enquanto direitos fundamentais constitucionalmente protegidos, destacando, ainda, o enquadramento do princípio da dignidade humana no âmbito desta temática. Nas linhas que se seguirão irá ser concretizada uma reflexão formal do conceito de suicídio e, para uma melhor contextualização da temática, mostra-se relevante ter em conta o enquadramento jurídico deste termo noutros ordenamentos, destacando os traços distintivos da doutrina espanhola, realizando uma explanação sobre a licitude ou ilicitude do suicídio. E, impreterivelmente, evidenciamos, ainda, as divergências no ordenamento jurídico português. Nesta análise abordaremos conceitos pertinentes que permitirão elaborar uma contraposição entre o auxílio ao suicídio e o homicídio a pedido da vítima, plasmado no art. 134º do CP e, ainda, salientar-se-ão algumas características da eutanásia, de forma a se diferenciar da figura do suicídio. Encerra-se a exposição procedendo a uma análise do crime de incitamento ou ajuda ao suicídio, do art. 135º do CP, explanando o seu tipo subjetivo e objetivo assim como, os vícios de vontade. Salientamos a problemática que envolve os comportamentos de incitar e ajudar ao suicídio, manifestando o maior desvalor e censurabilidade da conduta de incitamento face ao auxílio, permitindo-nos, assim, concluir pela não conformação com a moldura penal apresentada por este tipo legal de ilícito.
The present dissertation will approach the problematic application of the same legal frame of the behaviors of urging and aiding to suicide, which the practice of it is inserted in the illicit type of the article 135º of the PC, which has caused some controversy in the doctrine and in the jurisprudence, generating unrest in the areas connected to the ethics, morals and religion. Initially, it will be made an exposition about the inviolability of the right to life (art. 24º of the PRC), reaching out to its constitutional strength as much as the existing controversy between that right and the autonomy of the human being, as fundamental rights that are constitutionally protected, highlighting the frame of the principle of human dignity in the ambit of this thematic. In the following lines, it will be made a formal reflection of the concept of suicide and, to a better contextualization of the thematic, it is relevant to keep in mind the legal frame of this term in other alignments, highlighting the distinctive traces of the Spanish doctrine, making an explanation about the lawfulness or illegality of suicide. With that being said, we forcibly highlight the divergence in the Portuguese legal alignment. In this analysis we will approach relevant concepts that will allow the elaboration of a counter position between the aid to suicide and the homicide by the victim request, present in the art. 134º of the PC, and yet, to emphasize some characteristics of the euthanasia in a way to distinguish it from the suicide figure. We finish this exposition by proceeding to an analysis of the crime of urging or aiding suicide, from the art. 135º of the PC, explaining it’s type of subjective and objective as well as the vices of their will. We highlight the problematic that involves the behaviors of urging and aiding the suicide, manifesting the greatest lack of value and censorship of the conduct of incitement towards aid, thus allowing us to conclude that it does not comply with the criminal framework presented by this legal type of offense.
