O direito e a justiça aos olhos do homem : a independência do poder judicial e a preservação do princípio da certeza, da segurança jurídica e da proteção da confiança dos cidadãos

| dc.description.abstract | Tendo por base o tema “o Direito e a Justiça aos olhos do Homem”, pretendemos fazer um estudo acerca da influência que o princípio da independência do poder judicial exerce sobre a preservação do princípio da certeza, da segurança jurídica e da proteção da confiança e da igualdade de tratamento no ordenamento jurídico português, em especial, através da uniformidade da jurisprudência. Tomando como ponto de partida esta problemática, ao longo do trabalho pretendemos especificamente analisar o princípio da independência judicia; o princípio de segurança, certeza e confiança no Direito, analisando a relação existente entre o principio da independência judicial e a possibilidade de decisões jurisprudenciais não uniformes e as consequências que podem trazer ao nível da segurança e confiança na boa realização do Direito da sua função; para, por fim, tomando em consideração os resultados obtidos, compreender se se verifica a necessidade de adoção de novas medidas de forma a garantir-se mais eficazmente a uniformidade jurisprudencial, como forma de preservar a segurança, igualdade e certeza jurídica e incrementar a confiança no Direito. Há, antes de mais, que realçar que todo o nosso estudo terá por base a perspetiva do cidadão comum em relação ao Direito e a necessidade de assegurar o efetivo sentimento de segurança de regência das condutas sociais pelo Direito, que a sociedade reclama, através de interpretações legais e decisões uniformes, perante condutas também elas semelhantes. Afinal, a verdade é que uma sociedade que se considera, cada vez mais “como igual”, dentro da própria diferença inerentes à diversidade social, não consegue confiar num “direito desigual”. | pt_PT |
| dc.description.abstract | Based on the theme "Law and Justice in the eyes of Man", we intend to study the influence of the principle of the independence of the judiciary on the preservation of the principle of certainty, legal certainty and the protection of trust and of equal treatment in the Portuguese legal system, in particular through the uniformity of the case-law. Taking this problematic as a starting point, throughout the work we intend specifically to analyze the principle of judicial independence; the principle of security, certainty and trust in the law, analyzing the relationship between the principle of judicial independence and the possibility of non-uniform jurisprudential decisions and the consequences they can bring to the level of security and confidence in the proper fulfillment of the law of its function; to finally take into account the results obtained, to understand whether there is a need to adopt new measures in order to ensure more uniformity of case law as a way of preserving safety, equality and legal certainty and increasing confidence in the Law. First of all, it should be stressed that our entire study will be based on the common citizen's perspective on the law and on the need to ensure the effective sense of security in the conduct of social conduct by law, which society demands through legal interpretations and uniform decisions, before similar conduct. After all, the truth is that a society that considers itself increasingly "as equal" within the very difference inherent in social diversity can not rely on an "unequal right". | pt_PT |
