Abstract(s)
A presente dissertação tem como objetivo fundamental a análise da relação entre os crimes de tráfico de pessoas e escravidão, na vertente laboral. Com a globalização e consequente mudança de paradigma na sociedade, as “zonas cinzentas” começaram a surgir, justificando o estudo sobre a necessidade de existência de três tipos legais que criminalizam a exploração laboral. Justifica-se, por isso, um estudo ao bem jurídico protegido pelos tipos legais em análise e, consequentemente, o tratamento destes em sede concursal. Posteriormente, releva um estudo sobre o tratamento internacional dos ilícitos estudados.
Defendemos uma efetiva mudança no ordenamento jurídico, considerando ultrapassada a ideia de que o crime de tráfico de pessoas e de escravidão são duas faces de moedas diferentes. É fundamental entender que o Direito terá que se adaptar ao contexto social em que nos inserimos e, por isso, consideraremos, ainda, a questão das molduras penais abstratas dos tipos legais em estudo.
The fundamental aim of the following dissertation is the analysis of the relations regarding Human Trafficking and Human Slavery, in concerns of forced labor. Globalization and further change in the perception of the world, led to the growth of the “gray areas”, which justifies the study about the need of the existence of three legal types criminalizing forced labor. Therefore, a study to the legal assets protected by the statutory types in analysis is justified and, consequently, their treatment concomitantly. There is also a study on the way the crimes studied are handled. In this dissertation, an effective change in the judicial context is defended, considering the idea that the crimes of human trafficking and slavery are two different sides of different coins is old fashioned. It is fundamental the understanding that the Law will have to be adapted to the social context in which we are and, as such, the question of the abstract criminal frames of the legal assets in study are also considered.
