A presente dissertação diz respeito a um tema que tem assoberbado os media e as redes sociais: a violência obstétrica. Vamos falar de uma forma de violência que inclui um conjunto de condutas que violam direitos constitucionalmente protegidos da mulher e a nossa análise tem como base estudos nacionais e internacionais de onde resultam relatos assustadores de práticas realizadas por profissionais de saúde nos estabelecimentos de saúde, a legislação vigente e as recomendações internacionais que têm surgido como resposta a este problema. Pretendemos avaliar se existe em Portugal uma verdadeira necessidade jurídico-penal de criminalizar estas condutas, ou se o nosso ordenamento jurídico já dispõe de mecanismos suficientes para garantir a tutela dos bens jurídicos em causa.
This dissertation aims to study a theme that has overwhelmed the media and social networks, obstetric violence. It portrays a series of behaviors that violate women's constitutionally protected rights. This analysis is based on national and international studies, which result in frightening reports of the practices carried out by health professionals in health facilities, but also of international legislation and recommendations that have emerged as a response to this problem. In this sense, it is intended to assess whether there is, in Portugal, a legal-criminal need, namely to criminalize these conducts, or whether our legal system already has sufficient mechanisms to guarantee the protection of the legal assets at stake here.
