Na presente dissertação é feita a análise do artigo 138º do Código Penal, relativo aos crimes de exposição e abandono, sendo também feita a referência ao abandono animal. Foi feita uma pesquisa acerca destes temas através de variadas fontes bibliográficas para uma melhor compreensão dos mesmos. Conclui-se pela necessidade de alargamento do crime de exposição e abandono e pela urgência de uma revisão constitucional por forma a assegurar a criminalização do abandono animal em Portugal.
In the present dissertation, the article 138 of the Penal Code is analyzed, relating to the crimes of exposure and abandonment, and reference is also made to animal abandonment. A research was carried out on these topics through various bibliographic sources for a better understanding of them. It is concluded that there is a need to expand the crime of exposure and abandonment as well as an urgency of a constitutional review in order to ensure the criminalization of animal abandonment in Portugal.
