A valoração contratual da circunstância de o trabalhador se encontrar impedido de
comparecer ao serviço por se encontrar preso, quer na vertente preventiva, quer na vertente efetiva,
é um tema complexo. Este estudo procura analisar quais os entraves para a solução do problema e
para tanto é imprescindível uma análise jurisprudencial e doutrinal. Com esta dissertação,
procuramos demonstrar quais as soluções que consideramos mais pertinentes para alcançar o
resultado mais adequado, atendendo às posições do empregador e do trabalhador.
The contractual assessment of the employee inability to perform his professional obligations, due to the circumstance of him being arrested, whether it is in preventive detention or effective imprisonment due to conviction, is a complex subject. This study focuses on exposing the barriers to the solution of the problem and for this purpose an analysis of our superior courts decisions and doctrine is essential. With this dissertation we aim to showcase what are the solutions that we find relevant to achieve the most adequate outcome, taking into account the positions of both the employer and employee.
