A presente Dissertação busca estabelecer uma discussão acerca da temática pertinente da promoção da dignidade da pessoa humana para as mulheres reclusas, diante do cenário mundial dos últimos anos de aumento do encarceramento das mulheres. Para tanto, teremos de perceber o conceito de dignidade e de que forma este princípio pode atuar na garantia dos direitos humanos e fundamentais das mulheres, analisando quais normas internacionais preveem de forma mais clara e objetiva esses direitos, visando as necessidades específicas das mulheres no ambiente prisional. O sistema prisional foi nos primórdios criado apenas para receber o público masculino e por isso, ao longo da história, precisou ser objeto de discussão da Organização das Nações Unidas sobre a sua adequação para as mulheres, tanto em relação à forma que os Estados podem prestar assistência a elas, quanto em relação às mudanças necessárias nas estruturas prisionais. Além disso, será analisado se o Brasil, um dos países com a maior população prisional feminina do mundo adotou as medidas recomendadas pela ONU em sua legislação interna e de que forma garante o respeito à dignidade humana das mulheres, em comparação com Portugal, país localizado na Europa Ocidental, inserido em um contexto histórico diferente e com um contingente prisional mais reduzido face à realidade da América do Sul. Ao final, serão expostas as dificuldades encontradas nas análises feitas, bem como quais medidas foram adotadas pelos países e se demonstram ter eficácia na realidade prisional feminina.
This Dissertation seeks to establish a discussion on the pertinent theme of promoting human dignity for women prisoners, given the global scenario of recent years of increased incarceration of women. To do so, we will have to understand the concept of dignity and how this principle can act to guarantee the human and fundamental rights of women, analyzing which international standards provide these rights in a clearer and more objective way, targeting the specific needs of women in the prison environment. The prison system was initially created only to receive the male public and therefore, throughout history, needed to be the subject of discussion by the United Nations about its suitability for women, both in relation to the way in which States can provide assistance to them, as in relation to the necessary changes in prison structures. Furthermore, it will be analyzed whether Brazil, one of the countries with the largest female prison population in the world, has adopted the measures recommended by the UN in its internal legislation and how it guarantees respect for the human dignity of women, in comparison to Portugal, a country located in Western Europe, inserted in a different historical context and with a smaller prison contingent in view of the reality of South America. At the end, the difficulties encountered in the analyzes carried out will be exposed, as well as which measures were adopted by the countries and if it demonstrate to be effective in the promotion of human dignity on the female prison reality.
