Tem surgido, em vários países, um sentimento de insatisfação com o sistema de Justiça
criminal tradicional, originando a criação de abordagens judiciais alternativas, mais centradas
na dignificação e consideração da vítima. O papel da vítima na justiça restaurativa tem
suscitado diferentes opiniões no seio da comunidade cientifica. Através de uma análise
qualitativa dos dados, procurámos, com o presente estudo, refletir, analisar e compreender o
papel da vítima na justiça restaurativa, a partir das perspetivas de magistrados e técnicos de
apoio à vitima, de forma a contribuir para uma abordagem judicial que melhor responda às
necessidades das vítimas. Participaram no estudo seis magistrados e quatro técnicos de apoio
à vitima. Os resultados permitem as seguintes conclusões: a vitima deve ser considerada como
participante do processo judicial; os técnicos de apoio à vitima defendem que a vitima não é
tida em consideração no sistema judicial português; os participantes referem que as vítimas
recorrem ao sistema de justiça na esperança de uma mudança no comportamento do ofensor e
não em busca de uma punição; os técnicos de apoio à vitima destacam-se nas referências às
expetativas e sentimentos das vitimas, ao contrário dos magistrados que sugerem alguma
dificuldade em pôr-se no lugar da vitima; os participantes referem substancialmente mais
vantagens do que desvantagens relativamente ao impacto que as práticas restaurativas têm na
vítima.
In several countries, a feeling of dissatisfaction with the traditional criminal justice system has been mounting, generating the appearance of alternative judicial approaches centred more on dignifying and taking into account the victims. The role of restorative justice has given course to different opinions within the scientific community. In this study, we have tried to think about, analyse and understand the role of the victim in restorative justice through a qualitative analysis of data consisting of the points of view of six magistrates and four victim support services. Based on the results we formulated the following conclusions: the victim should be considered a participant in the judicial proceedings; the victim support services defend that the victim is not considered in the Portuguese justice system; the participants refer that the victims go to the justice system hoping the offender's behaviour will change and not searching for a punishment; the victim support services stand out on the reference to the expectations and feeling of the victims, instead of the magistrates that suggest some difficulties in wearing the victims' shoes; the participants referred more advantages that disadvantages relative to the impact of restorative practices on victims.
