Abstract(s)
In the present work we devoted ourselves to the study of the autonomous guarantee figure, more precisely to the guarantor's defense means, and our goal was to understand if, and in the case of affirmative answer, in which cases, the guarantor can refuse to comply with his obligation to pay the agreed amount to the beneficiary. To this end, we began by understanding what the autonomy of this guarantee consists of, which distinguishes it so much from the rest. In fact, it is by virtue of that autonomy that the question arises whether the guarantor can avail himself of means of defense to refuse to fulfill his obligation to pay the agreed amount to the creditor. Having understood the guarantee under consideration, we have examined whether the guarantor may refuse to fulfill his obligation taking into account three levels of legal relationship: the beneficiary-guarantor relationship (guarantee agreement), the guaranteed-guarantor relationship and the beneficiary-guaranteed relationship (base contract). After a long journey, always using portuguese doctrine and jurisprudence, we were able to reach our own conclusions. In fact, it is our understanding that the principle of the unavailability of defense by the guarantor contains exceptions, and the autonomy of the guarantee is not absolute. Thus, although its obligation is autonomous from its obligation to guarantee, the guarantor may refuse to comply with its obligation to pay the agreed amount on the grounds of the beneficiary-guarantor relationship and the beneficiary-guaranteed relationship.
