Abstract(s)
O presente trabalho relaciona-se com a lei nº32/2006 que regula a Procriação
Medicamente Assistida em Portugal. A problemática surge no contexto da PMA
heteróloga, em que existe a interferência de um terceiro estranho, designado como
dador. Neste âmbito, a PMA heteróloga surge como um desvio ao Princípio Verdade
Biológica.
As técnicas de PMA vêm trazer uma nova expectativa aos beneficiários que não
conseguiam gerar um ser através da procriação natural.
Na presente dissertação pretende-se: (1) identificar o Direito ao Conhecimento das
origens genéticas; (2) mencionar brevemente as técnicas de Procriação Medicamente
Assistida; (3) esclarecer algumas normas legislativas do ordenamento jurídico
português; (4) desenvolver o Direito do anonimato do dador; (5) realizar uma análise de
direito comparado do ordenamento jurídico Italiano.
The present work is related to the law nº 32/2006 that regulates Medically Assisted Procreation in Portugal. The problem arises in the heterologous MAP, in which there is the interference of a strange third, designated as a donor. In this context, the heterologous MAP appears as a deviation from the Biological Truth Principle. The techniques of MAP bring a new expectation to the beneficiaries who could not generate a being through the natural procreation. In the present dissertation it is intended: (1) to identify the Right to Knowledge of genetic origins; (2) briefly mention the techniques of Medically Assisted Procreation; (3) clarify some legislative provisions of the Portuguese legal system; (4) develop the right of donor anonymity; (5) perform an analysis of comparative law of the Italian legal system.
