Abstract(s)
As pessoas idosas, enquanto grupo populacional que sofre das mais diversas fragilidades,
não encontra no nosso ordenamento jurídico uma menção que se dirija a si de forma
específica. Cabendo em conceitos expressos pela lei, nomeadamente pelo Código Penal
e, vendo os seus bens jurídicos previstos na Constituição da República Portuguesa, não
há dúvidas de que merecem tutela penal. A situação dos idosos que residem em lares é
específica. Importa, então, analisar em que termos se poderão responsabilizar os lares e
seus funcionários, pela prática de maus tratos a idosos, de acordo com o nosso Código
Penal. Será o nosso ordenamento jurídico suficiente para defender as pessoas idosas e os
seus interesses, enquanto faixa etária cada vez mais crescente na nossa sociedade? É o
que nos propomos analisar.
Older people, as a population group suffering from the most diverse weaknesses, do not find in our legal system a mention that addresses itself in a specific way. Fitting in concepts expressed by the law, namely by the Penal Code and, seeing their protected legal interest provided at the Constitution of the Portuguese Republic, there is no doubt that they deserve criminal protection. The situation of the elderly living in nursing homes is specific. It is important to analyze in what terms the homes and their employees can be held responsible for the practice of the elder maltreatment, in accordance with our Penal Code. Is our legal system sufficient to defend the elderly and their interests as an increasingly growing age in our society? This is what we propose to analyze.
