As sociedades desportivas têm vindo a ganhar importância no ramo do direito societário. Tal advém, nomeadamente, das controvérsias e disputas jurídicas que têm surgido no panorama desportivo nacional (C.F. Belenenses vs. B.SAD; CD. Aves vs. C.D. Aves SAD, p.ex). Nessa medida, surgiu-nos o interesse de redigir uma dissertação que identificasse e problematizasse as soluções atualmente consagradas em ordem a proteger os clubes fundadores de sociedades desportivas. Neste trabalho foi efetuado um estudo pormenorizado das normas que se aplicam às sociedades desportivas, nomeadamente aquelas que resultem da personalização jurídica da equipa desportiva. Devemos destacar a dedicação com que abordamos as normas que dispõe sobre o património desportivo edificado, questão nevrálgica, e que na nossa ótica, estará na base de atuais e potencias conflitos entre clubes fundadores e sociedades desportivas. Não podemos deixar de assumir como limitação o facto de ser parca a doutrina que se debruça sobre as sociedades desportivas. Mais limitativo se torna quando o seu próprio regime legal é alvo de alterações legislativas constantes.
Sports Societies have been gaining importance in the field of Corporate Law. This comes, mainly, from the legal controversies and disputes that have been arising in the national sports scene. (C.F. Belenenses vs. B.SAD; CD. Aves vs. C.D. Aves SAD, for example). This arose in me interests of writing a dissertation that would identify and treat the solutions that are consecrated to protect the founding club of a sports society. In this dissertation I made a detailed study of the legal solutions that are appliable to sports societies that result from the legal personalization of the sports team, mainly the ones that dispose about sportive patrimony, wich is the base of actual and potential conflicts between the founding club and the sports society. I can´t deny that the short number of authors that have written about sports societies was a limitation. More limiting it becomes when the legislator is constantly producing legislative changes in the legislation of sports societies.
