| dc.description.abstract | Na presente dissertação analisamos a problemática dos acidentes de trabalho ocorridos em regime de teletrabalho subordinado, uma realidade cada vez mais presente no contexto laboral português, especialmente após a pandemia COVID-19. A investigação inicia com um enquadramento histórico e legal do teletrabalho, demonstrando a sua evolução normativa até à atual regulação pelo Código do Trabalho, incluindo as alterações feitas pela Lei nº83/2021. Em seguida, é explorado o conceito legal de acidentes de trabalho, com base na Lei nº98/2009, destacando aspetos como o tempo, lugar e o nexo de causalidade. A dissertação aprofunda os desafios jurídicos que surgem quando os acidentes ocorrem no domicílio do trabalhador, em regime de teletrabalho, especialmente quanto à distinção entre acidentes de trabalho e acidentes domésticos, e a aplicabilidade dos acidentes in itinere no regime do teletrabalho no domicílio. | por |
| dc.description.abstract | In the present dissertation, we analyze the issue of work-related accidents occurring under the regime of subordinate telework, a reality increasingly present in the Portuguese labor context, especially after the COVID-19 pandemic. The research begins with a historical and legal framework, demonstrating its normative evolution up to the current regulation by the Labor Code, including the amendments introduced by Law no.83/2021. Next, the legal concept of work-related accidents is explored, based on Law no-98/2009, highlighting aspects such as time, place and casual link. The dissertation delves into the legal challenges that arise when accidents occur at the worker’s home under telework, particularly regarding the distinction between work-related and domestic accidents, and the applicability of the in itinere accidents within the home-based telework regime. | eng |
