Abstract(s)
O compliance consolidou-se como ferramenta essencial na prevenção da corrupção e de toda a criminalidade em Portugal, tendo sido impulsionado pela Estratégia Nacional Anticorrupção, pelo Regime Geral da Prevenção da Corrupção e Lei nº 94/2021. No presente estudo pretendemos analisar as origens do movimento de cumprimento normativo com base na autorregulação regulada a nível internacional e nacional. Para isso procedemos à revisão de literatura e análise legislativa na perspetiva de identificar desafios e apontar possíveis soluções. Concluiremos pela existência de algumas inconsistências na redação e forma de implementar a legislação relativa ao cumprimento normativo. Desafios como o window dressing e a privatização de investigações criminais exigem regulamentação aprimorada. A eficácia do compliance em Portugal dependerá de ajustes legislativos que promovam uma cultura ética e garantam segurança jurídica às empresas, fortalecendo o combate à criminalidade no seio das pessoas coletivas.
Compliance has established itself as an essential tool in preventing corruption and all kinds of crime in Portugal. It has been promoted by the National Anti-Corruption Strategy, through the General Regime for the Prevention of Corruption, and Law No. 94/2021. This study aims to analyze the origins of the regulatory compliance movement based on regulated self-regulation at international and national levels. To this end, we conducted a literature review and legislative analysis to identify challenges and point out possible solutions. We conclude that there are some inconsistencies in the wording and implementation of legislation on regulatory compliance. Challenges such as window dressing and the privatization of criminal investigations require improved regulation. The effectiveness of compliance in Portugal will depend on legislative adjustments that promote an ethical culture and guarantee legal certainty for companies, strengthening the fight against crime within legal entities.
