| dc.description.abstract | O Direito e as Ciências da Comunicação caminham lado a lado. Ambos se inserem, ditam e regulam a sociedade. No entanto, no que toca ao tema do discurso mediático humorístico no campo do Direito, as dúvidas ainda são muitas. Como pode ser regulado sem implicar restrições à liberdade de expressão, mas sem permitir abusos na esfera dos alvos do discurso? Nesta investigação propusemos, em primeiro lugar, a investigação dos dois campos em separado, fazendo uma teorização das temáticas relevantes para o método investigativo que iriamos utilizar. E em segundo, conduzimos uma investigação prática, analisando a forma como o discurso jurídico se posiciona em relação ao discurso mediático humorístico. Para isso, e com recurso a instrumentos de Análise Discursiva, estudámos duas decisões de cariz jurídico referentes a textos de discurso humorístico. A partir desta análise fomos capazes de identificar pontos semelhantes nas quais as decisões se encoraram: a mensagem e a interpretação da mensagem do discurso mediático humorístico. Embora as decisões selecionadas difiram na sua resolução, ambas se encoram na forma como o público é capaz de receber o humor. Não existe uma resposta única, final e totalmente consensual quanto à problemática. Mais, qualquer um dos textos que nos serviu de base é passível de discordância. Mas para haver discordância é necessário que existam reflexões teórico-práticas sobre esta temática social tão atual e foi precisamente isso que nos levou à realização desta dissertação. | pt_PT |
| dc.description.abstract | Law and Communication Studies walk side by side. Both insert, dictate, and regulate society. However, when it comes to the subject of humorous media discourse in the field of law, the doubts are still many. How can it be regulated without implying restrictions on freedom of speech, but without allowing abuses in the sphere of the subjects of the discourse? In this research we proposed, firstly, to investigate the two fields separately, making a theorization of the relevant themes for the investigative method we were going to use. And secondly, we conducted a practical investigation, analysing how the legal discourse positions itself in relation to the humorous media discourse. To do so, and using Discourse Analysis tools, we studied two legal decisions referring to humorous discourse texts. From this analysis, and although the decisions are different, we were able to identify similar points in which the arguments for the decisions are based: the message and the interpretation of the message of the humorous media discourse. There is no single, final, and totally consensual answer to the problem. Moreover, any of the texts on which we have based ourselves is liable to disagreement. But for there to be disagreement it is necessary that there are theoretical and practical reflections on this very current social theme and that is precisely what led us to this dissertation. | pt_PT |
