A relevância sucessória das liberalidades feitas em vida pelo de cujus, manifesta-se em vários momentos da sucessão legitimária. O autor da sucessão tem total liberdade de dispor em vida, quer a título gratuito quer a título oneroso de todos os seus bens, mas após a sua morte no cálculo do valor da herança, para o efeito único da determinação do valor da legítima, o legislador manda acrescentar aos bens deixados o valor dos bens doados pelo de cujus, sem estabelecer qualquer limite temporal para a sua relevância, ao contrário do que acontece noutros ordenamentos jurídicos. A lei faculta aos herdeiros legitimários vários meios de proteção da legítima, sendo o instituto da redução das liberalidades inoficiosas o mais importante. Este instituto faz prevalecer o direito dos herdeiros legitimários sobre o direito do dispor de de cujus e os direitos dos donatários tornando de algum modo precárias as aquisições a título gratuito, precariedade essa que se pode manter por muitos anos dada a esperança média de vida em Portugal.

The author of the succession is entirely free to dispose in life, whether as owner or for consideration, whether for the sake of it or for consideration of all his assets, but after his death in calculating the value of the inheritance, for the sole purpose of determining the value of the reserved share, the legislator has the value of the goods donated by the de cujus added to the left goods, without any time limit on their relevance, unlike in other legal systems. The law provides forced heirs various figures of protecting the reserved share, the most important being the figure of action for abatement of dispositions. This figure prevails the right of forced heirs over the right to dispose de cujus and the rights of grantees making the free acquisitions somewhat precarious, a precariousness that can be maintained for many years given the average life expectancy in Portugal.
