A dissertação de mestrado debruça-se sobre o advento da Inteligência Artificial no setor financeiro, em particular a sua aplicação na gestão de fundos de investimento, que assumem um papel cada vez mais relevante no equilíbrio e desenvolvimento dos mercados financeiros. O estudo procura compreender de que forma estas novas tecnologias 4 com capacidade para analisar grandes volumes de dados, automatizar decisões e redefinir estratégias de alocação de ativos 4 podem contribuir para uma maior eficiência e racionalidade nos investimentos, sem que isso comprometa os princípios fundamentais da tutela do investidor. Reconhecendo que estas inovações trazem benefícios, mas também riscos acrescidos, a investigação propõe uma análise do regime jurídico da responsabilidade civil aplicável às sociedades gestoras de organismos de investimento coletivo que recorrem à IA. Adicionalmente, são abordadas, ainda que de forma breve, algumas medidas preventivas suscetíveis de contribuir para a mitigação ou erradicação dos danos que possam vir a ocorrer.
This Master’s dissertation examines the emergence of Artificial Intelligence in the financial sector, with particular focus on its application in the management of investment funds 4 actors that increasingly play a pivotal role in the stability and development of financial markets. The research seeks to assess the extent to which these technologies 4 endowed with the ability to process large volumes of data, automate decision-making, and reshape asset allocation strategies 4 may enhance investment efficiency and rationality, while still upholding the fundamental principles of investor protection. Acknowledging that such innovations bring not only benefits but also heightened risks, the study undertakes a legal analysis of the civil liability regime applicable to management companies of collective investment undertakings employing AI systems. Furthermore, the dissertation explores, albeit briefly, certain preventive measures that may contribute to the mitigation or elimination of potential harm.
