Versa a presente investigação sobre a responsabilização dos progenitores aquando de condutas irrefletidas e impensadas no âmbito do ciberespaço, em especial a publicação de imagens dos seus filhos, enquanto menores. O principal objetivo é a proteção no âmbito dos direitos fundamentais, com especial atenção para o direito à imagem e o direito à privacidade, nunca dispondo dos restantes direitos que entram em confronto com esta realidade. Percebe-se que o direito à privacidade necessita de ser repensado relativamente aos dias correntes, e que a proteção ao nível da imagem está longe de ser a “ideal” relativamente a menores de 16 anos. Sendo norteada toda a investigação em torno da existência ou possível existência de um novo ilícito.
The present investigation reflects on the responsibility of the parents when conducting in thoughtless and unthought manners in the scope of cyberspace, in particular in the publication of images of their children. The main goal is the protection in the scope of fundamental rights, with special attention to the right to image and the right to privacy, never giving up the other rights that come into conflict with this reality. It is perceived that nowadays the right to privacy needs to be rethought, and that image protection is far from ideal for those under the age of 16.All investigation was guided around the existence or possible existence of a new criminal offense.
