Os progressos tecnológicos no âmbito da ciência médica propiciam o aparecimento de novas e intrincadas figuras jurídicas. As wrongful actions são exemplo desse fenómeno. O wrongful birth e a wrongful life surgem por virtude de um erro no diagnóstico pré-natal, ao passo que, a wrongful conception deriva da falha numa operação de esterilização, de interrupção da gravidez ou de defeito do método contracetivo. A complexidade que lhes está subjacente advém, desde logo, da multiplicidade e diversidade de problemáticas que suscitam e culmina na divergência doutrinal e jurisprudencial que ainda hoje é patente. O presente estudo tem como finalidade averiguar a possibilidade de recurso à responsabilidade civil como meio subsidiário, alternativo ou suplementar aos sistemas de segurança social, na prossecução do objetivo de garantir a adequada tutela aos seres humanos portadores de deficiência.
The medical science field’s technological advances provide the appearance of new and intricate legal figures. Wrongful actions are an example of said phenomenon. Wrongful birth and wrongful life appear due to medical malpractice during prenatal diagnosis, while wrongful conception emerges from a failure in sterilization, abortion procedures or from a deficiency on the contraceptive method. The underlying complexity of the afore mentioned actions arises from the multiplicity and diversity of the problems they carry and reveals itself on the current doctrinal and jurisprudential divergence. The purpose of this paper is to ascertain whether civil liability may act as a subsidiary, alternative or additional mean to the social security systems, with the goal of ensuring an adequate protection of the disabled human beings.
