A presente dissertação terá como principal objetivo desenvolver o tema sobre a Proteção de Dados Pessoais no âmbito do Comércio Eletrónico.
A decisão em realizar a presente dissertação foi motivada essencialmente pelo meu gosto pessoal, interesse e curiosidade por esta área do Direito, em virtude de ser uma utilizadora assídua das novas tecnologias e dos serviços proporcionados pelo comércio eletrónico, por exemplo, compras online. Por ser precisamente, uma utilizadora assídua destes serviços, sempre tive curiosidade em tentar perceber como era realizado todo o processo da transferência de dados pessoais. Assim, juntamente com o facto de que no próximo dia 25 de Maio será aplicável o Regulamento Geral da proteção de Dados, considerei interessante analisar o mesmo e fazer uma ligação ao comércio eletrónico.
Posteriormente, em consonância com a minha orientadora, Professora Filipa Calvão, optamos por especificar este tema e analisar a aplicação articulada do RGPD e do regime da e-Privacy: os testemunhos de conexão (cookies).
Foi muito desafiante desenvolver este tema, tendo em conta que deparamo-nos atualmente com uma sociedade digital e, que uma parte significativa da sociedade, recorre cada vez mais aos serviços proporcionados pelas inovações tecnológicas bem como dos serviços do comércio eletrónico sem terem consciência dos riscos associados aos mesmos.
Em suma, o presente estudo foi feito com muito trabalho e dedicação e, por essa razão, o objetivo que estabeleci foi alcançado.
The main objective of this dissertation is developing the theme on the Protection of Personal Data in the scope of electronic commerce. The decision to carry out this dissertation was motivated mainly by my personal interest and curiosity for this area of Law, due to the assiduous use of new technologies and services provided by electronic commerce, for example, online purchases. Furthermore, I always had a been a very frequent user of these services, consequently I was always curious to try to understand how the whole process of transferring personal data was carried out. Thus, together with the fact that next May 25 will be applied the General Data Protection Regulation, I considered it interesting to analyze it as well as make a connection to electronic commerce. Subsequently, in line with my counselor, Professor Filipa Calvão, we chose to specify this topic and to analyze the articulated application of the RGPD and the e-Privacy regime: the witnesses of connection (cookies), being it the phenomena of the digital era. It has been very challenging studying this subject, considering that we are currently living in a digital society, a significant part of this society are increasingly relying on the services provided by technological innovations as well as e-commerce services without being aware of the associated risks to them. To sum up, the present study was done with a lot of work and dedication, and for that reason, the objective that I established was achieved.
