A presente dissertação tem como objeto de estudo o regime fiscal das mais-valias imobiliárias, em especial o regime de reinvestimento previsto no artigo 10.º, n.º 5 do CIRS. Nesse sentido, cumpre-nos analisar as modalidades de reinvestimento das Mais-Valias imobiliárias apuradas com a venda da casa destinada a habitação própria e permanente. Para o efeito, refletimos sobre determinadas modalidades menos usuais do reinvestimento, nomeadamente, aquela modalidade que compreende a complexidade do contrato-promessa compra e venda e a “recente” possibilidade de reinvestir em produtos financeiros. Por fim, identificamos possíveis dificuldades práticas na concretização das opções criadas pelo legislador, no âmbito do reinvestimento.
The main subject of this dissertation is the tax regime for real estate capital gains, in particular the reinvestment regime, provided in article 10, n.º 5 of the Portuguese Corporate Income Tax Code. In this sense, we focus our analysis on the modalities of reinvestment of real estate capital gains obtained from the sale of the house intended for own and permanent residence. To this end, we reflect on certain less usual modalities, namely, the modality that comprises the complexity of the promissory purchase and sale contract and the "recent" possibility of reinvesting in financial products. Finally, we identify possible practical difficulties in implementing the options created by the legislator in the context of reinvestment.
