O presente estudo tem como objetivo refletir sobre uma das mais impactantes disfuncionalidades do regime português no âmbito das relações coletivas: a ausência de critérios de representatividade sindical. A ausência de medição da representatividade sindical conduz a que nos interroguemos se o atual espectro dos sindicatos representa de forma legítima e defende adequadamente os interesses dos trabalhadores. Neste domínio, é sobretudo ao nível da contratação coletiva e da concertação social que esta matéria adquire maior acutilância. Ao longo do estudo, são apontados motivos que sustentam a nossa tese de que se justifica repensar o modelo de representatividade sindical em Portugal. Os modelos comparados, espanhol e francês, serviram de base à nossa reflexão e de suporte para a apresentação de um conjunto de recomendações, cujo propósito é o de inspirar o nosso legislador na implementação de critérios de representatividade sindical.
The purpose of this study is to reflect on one of the most impactful dysfunctions of the Portuguese regime in the scope of collective relations: the absence of criteria for union representativeness. The absence of measurement of union representativeness raises questions about whether the current range of unions legitimately represents and effectively defends the interests of workers. In this domain, the issue of representativeness becomes most acute primarily at the level of collective bargaining and social concertation. The study emphasizes the need to rethink the model of union representativeness in Portugal. A comparative analysis of the Spanish and French regimes was used as the basis for our reflection and to support the presentation of a set of recommendations, aimed at inspiring our legislature to implement of criteria for union representativeness.
