Num mundo cada vez mais digital, os algoritmos são a sua estrela em ascensão. A discriminação algorítmica coloca-nos desafios de difícil resolução, implicando uma análise crítica do enquadramento legal existente. Assim, a presente Dissertação procede à reflexão sobre as diferentes situações em que a discriminação algorítmica pode surgir, avaliando se fará ou não sentido aplicar o direito antidiscriminação. De seguida, destacamos o papel que o Regulamento da Inteligência Artificial terá na regulamentação desta matéria, fazendo a articulação necessária com o Regulamento Geral da Proteção de Dados. Finalmente, apontamos as soluções que, em nosso entendimento, poderão dar uma resposta efetiva à discriminação algorítmica nesta era do constitucionalismo digital.
In a more digitalized world, algorithms are its rising star. Algorithmic bias poses difficult challenges, implying a critical analysis to the existent legal framework. Hence, the following Dissertation proceeds to the reflection about the different situations where algorithm bias can arise, evaluating if it will make sense to apply an antidiscrimination law. Then, we highlight the role that the Artificial Intelligence Act will have in the regulation of this matter, by doing the necessary articulation with the General Data Protection Regulation. Finally, we point out solutions that, in accordance to our understanding, will give an effective answer to the algorithmic bias in this new era of digital constitutionalism.
