A presente dissertação versa sobre a descaracterização do acidente de trabalho em duas modalidades: a proveniente da negligência grosseira do trabalhador e a resultante da privação do uso da razão por embriaguez daquele. Encontra-se dividida em quatro capítulos que versam sobre a evolução histórica do acidente de trabalho; os pressupostos essenciais do mesmo; a sua descaracterização e a conclusão. Ao longo da mesma, tentaremos problematizar separadamente os dois temas essenciais da presente dissertação – a negligência grosseira do trabalhador e a sua embriaguez como causas do acidente de trabalho e as suas consequências. Cumpre-nos, desde já, referir que apesar de os acidentes de trabalho serem um tema explorado pela doutrina, a sua descaracterização é aprofundada por muito poucos autores. Neste sentido, pretendemos, com a presente, impulsionar a escrita sobre o tema, abordando para tal alguma jurisprudência nacional recente que demonstra a importância que aquele ainda hoje tem.
The present dissertation deals with the decharacterization of the workplace accident in two modalities: that derived from the gross negligence of the worker and the result of the deprivation of the use of the reason for the drunkenness of the worker. It is divided into four chapters that deal with the historical evolution of the work accident; the essential assumptions of it; its decharacterization and conclusion. Throughout it, we’ll try to separately problematize the two essential themes of the present dissertation - the gross negligence of the worker and his drunkenness as causes of the accident at workplace and its consequences. We should point out that although work accidents are a subject explored by the doctrine, its decharacterization is deepened by very few authors. In this sense, we intend, with the present, to boost the writing on the subject, addressing for this some recent national jurisprudence that demonstrates the importance that it still has today
