Abstract(s)
O presente trabalho consiste na dissertação de Mestrado em Direito Administrativo apresentada na Escola do Porto da Faculdade de Direito da Universidade Católica Portuguesa sobre o tema dos “Contratos de Cooperação “Horizontal” entre Entidades Públicas”, que espero ter alcançado o nível de excelência pretendido. Mais especificamente, estuda os contratos de cooperação horizontal com base, sobretudo, na jurisprudência europeia, no regime das diretivas 2014 que trouxe a sua consagração legal e na transposição efetuada pelo legislador português no art. 5º-A nº5 do CCP.
Precisamente, pretende-se: 1) explicar a pertinência e atualidade da noção de cooperação horizontal e estudar a sua exclusão da contratação pública; 2) descortinar a razão de ser e as vantagens que comporta; 3) delimitá-la das figuras afins de contratação excluída; 4) mostrar o panorama que envolveu a sua positivação; 5) explicitar que é ilustrativa do fenómeno da europeização da contratação pública. Também se visa o estudo dos requisitos da cooperação horizontal e, por isso: 6) analisá-los detalhadamente; 7) explicitar as incertezas e dúvidas que pairam sobre esta figura e que, com a sua novidade, a tornam numa das hot issues da contratação pública na atualidade e 8) apresentar o nosso entendimento sobre essas dúvidas respeitantes ao alcance dos requisitos da figura.
Espera-se ter contribuído com esta dissertação para uma clarificação do regime da cooperação público-pública e das vantagens que a sua celebração pode trazer às entidades adjudicantes que a ela recorram, ficando a conhecer melhor este novo tipo contratual, para que no momento da decisão de contracting in ou out, isto é, de make ou buy (sendo possível optar), a sua escolha seja segura e estejam cientes das vantagens que a cooperação horizontal lhes pode aportar. Pretende-se que esta tese constitua mais uma pedra no caminho da cooperação público-pública, desejando facilitar a sua celebração, tornando-a frequente na Administração Pública, tendo em conta o contexto económico-financeiro e as restrições orçamentais da Administração Pública e das entidades adjudicantes em Portugal e na zona euro.
The present work consists of the Administrative Law Master Thesis presented in the Oporto Law School of the Faculty of Law of Universidade Católica Portuguesa regarding “Horizontal” Cooperation Contracts between Contracting Authorities”, which one aspires have achieved the level of excellency intended. More specifically, it studies the “horizontal” cooperation contracts, based on the ECJ’s jurisprudence, the Public Procurement 2014 European directives which have created their legal dispositions and finally on the transposition made by the Portuguese legislator in the art. 5º-A nº5 of the Portuguese Public Contracts’ Code. Precisely, we pretend to: 1) explain the pertinence and the current adequacy of the notion of “horizontal” cooperation at the time of the writing and study its exclusion of the public procurement; 2) uncover its ratio legis and the advantages that they create; 3) distinguish it from the closer figures excluded from public procurement; 4) show the panorama which involved its positivation; 5) make explicit that these contracts are illustrative of the public procurement Europeanization’s phenomenon. We also want to study the legal requirements of the “horizontal” cooperation and therefore: 6) analyze them in detail; 7) make explicit the uncertainties and doubts that surround this figure which with the aid of its novelty, made them one of the current public procurement burning issues and 8) present our understanding on these questions and doubts related to the meaning and impact of this contractual type’s requirements. We hope to have contributed with this dissertation to a legal clarification of the public-public cooperation’s legal dispositions and the advantages that their celebration can bring to contracting authorities who sign them, so that at the moment of deciding between contracting in or out, i.e., make or buy (if such a possibility exists), their choice is safer and there is greater awareness of the benefits they can obtain. We pretend for this thesis to constitute one more stepping stone towards public-public cooperation, in order to facilitate its celebration, making its use more frequent in Public Administration, mostly given to the economic and financial context and budget restrictions in Public Administration and contracting authorities in Portugal and also in the Euro zone.
