| dc.description.abstract | A presente dissertação versa sobre o crime de infanticídio, previsto e punido pelo artigo 136.º do Código Penal. Por ser um tipo legal que levanta diferentes questões, reduzimos o escopo da nossa investigação a três matérias: o conceito de influência perturbadora do parto; a (falta de) Perícia; e os problemas ao nível do Direito e Género. A dissertação inicia com uma breve passagem pela história legal do crime de infanticídio em Portugal, passando, de seguida, para um exame mais profundo sobre os elementos que constituem a sua tipologia. Posteriormente, faz-se referência a algumas decisões jurisprudenciais portuguesas, dos últimos anos, e ao modo como o crime de infanticídio (não) está a ser aplicado. De seguida, procura-se chegar a um conceito unívoco de influência perturbadora do parto, salientando-se, ainda, a importância da perícia como meio de prova. Através da elaboração de entrevistas com diferentes intervenientes, numa tentativa de aproximação à realidade, esta dissertação procura fornecer novos elementos para a correta leitura do presente dispositivo legal. E, por fim, destaca os problemas que as últimas decisões judiciais evidenciam ao nível do Direito e Género. O objetivo deste trabalho passa essencialmente por colocar em evidência uma realidade que, apesar de recorrente e atual, se encontra espelhada num tipo legal mal interpretado e adormecido e por fornecer novos elementos para futuras decisões judiciais. | pt_PT |
| dc.description.abstract | The present dissertation focuses on the crime of infanticide, foreseen and punished by article 136 of the Penal Code. Since it is a legal type that raises different questions, we have reduced the scope of our investigation to three subjects: the concept of disruptive influence of childbirth; the (lack of) Expert Evidence; and Law and Gender issues. This dissertation begins with a brief review of the legal history of infanticide in Portugal, followed by a deeper examination of the elements that make up its typology. Afterwards, it focuses on Portuguese jurisprudential decisions in recent years and how the crime of infanticide is (not) being applied. Then, it seeks to arrive at an unambiguous concept of disruptive influence of childbirth, highlighting the importance of expert evidence as a means of proof. Through the elaboration of interviews with different intervening parties, in an attempt to get closer to reality, this dissertation seeks to provide new elements for the correct reading of this legal provision. And, finally, it highlights the problems that the latest court decisions reveal in terms of Law and Gender. The aim of this work is essentially to highlight a reality that, despite being current, is reflected in a misinterpreted and dormant legal type and to provide new elements for future judicial decisions. | pt_PT |
