Abstract(s)
A presente dissertação versará sobre o crime de violência doméstica, no contexto das relações de namoro. A violência doméstica é uma realidade amplamente reconhecida na nossa sociedade que não podemos escamotear e que, infelizmente, já ceifou a vida a algumas vítimas. A questão da violência doméstica tem sido alvo de preocupação tanto a nível público como político, dada a proximidade de relação que o agressor e a vítima têm entre si, sendo, muitas vezes, no meio familiar e no lar, onde este crime é praticado quando seria de esperar que este fosse um lugar seguro e protegido. Procuraremos analisar criticamente o art. 152.º nº1 alínea b), do Código Penal, na redação que lhe foi dada pela Lei n.º 19/2013, de 21 de fevereiro, a qual se encontra em vigor, sem descurar uma breve nota histórica do preceito. Como referimos, analisaremos o crime de violência doméstica, no contexto das relações de namoro, mas, afinal, em que consiste o “namoro” nos nossos dias? Procuraremos neste trabalho responder a esta questão tendo por base algumas considerações sociológicas, bem como, os ensinamentos da Doutrina e da Jurisprudência existentes sobre este tema. Analisaremos o tema à luz do Direito Comparado e apresentaremos por fim as conclusões a que chegarmos.
The following dissertation will deal with the crime of domestic violence in the context of dating relationships. Domestic violence is a widely recognized reality in our society that can’t hidden and unfortunately has already killed some victims. The issue of domestic violence has been a matter of concern both at public and political levels given the proximity of the relationship between the perpetrator and the victim, often in the family and home, where this crime is practiced when it would be expected to be a safe and secure place. We will critically examine article 152, number 1, paragraph b) of the Penal Code in the wording given to it by Law 19/2013, of February 21, which is in force without neglecting a brief historical note of the precept. As we mentioned, we will analyse the crime of domestic violence, in the context of dating relationships, but after all, what is the meaning of "courtship" nowadays? We will try to answer this question based on some sociological considerations, as well as the teachings of the existing Doctrine and Jurisprudence on this subject and review the subject in the light of Comparative Law to present the conclusions we have reached at the end.
