Abstract(s)
Enquanto tecnologia disruptiva, a inteligência artificial (IA) coloca desafios significativos ao Direito em geral, e à Propriedade Intelectual em especial, na medida em que viabiliza a criação de imateriais potencialmente enquadráveis nos sistemas de proteção principais (Direito de Autor e Direito de Patentes). Partindo desta premissa, analisaremos os pontos fulcrais do impacto da IA nos paradigmas da Propriedade Intelectual, no sentido de perceber em que medida é que estas criações se encontram (des)protegidas.
As a disruptive technology, artificial intelligence (AI) poses significant challenges to law in general, and to Intellectual Property (IP) in particular, insofar as it allows the development of intangible assets that could potentially qualify for protection under Copyright law or Patent law. We will thus analyse the main challenges brought by AI to the paradigms of IP law, in an attempt to understand to what extent are these creations (un)protected.
